What to do if the Debtor Disputes your Claim

It is not uncommon for a bankrupt debtor to dispute the amount claimed by a creditor on their Proof of Claim form.  Here is one technique that may be effective in resolving the dispute without involving your attorney.

  1. Ask for documentation showing what the debtor’s records indicate was open at the time of the bankruptcy filing.
  2. The next step is to reconcile their statement with your records.
  3. The third step is to determine if the debtor is correct.  If so, amend your claim.
  4. If your records are correct, provide a written explanation of the variance and all relevant supporting documentation.
  5. Follow up with the debtor.  Ask them to withdraw their objection based on the documentation you have provided.
