Small Claims Court for Out of State Debtors

A commonly asked question about Small Claims Court is:  Can we pursue a small debtor ourselves in small claims court even if that debtor is in another State?

The answer is yes... but to do so you must file your claim in small claims court in the debtor's jurisdiction. This means that a creditor has to sue the debtor in their state's small claims court system.  For this reason and because of the costs associated with travel, business creditors usually find that out of state small claim court debt collection efforts are simply not cost-effective.
